There was a woman who lived in the early 1900's in and around Joshua, Texas. Her name is not important but her actions show an amount of financial acumen that should be duplicated today. Based on the number of warranty deeds that I have reviewed over the years in the early 1900's it was somewhat out of the ordinary for women who were single to transact in land purchases and sales on a regular basis. The mentioned nine acres of minerals were included in a couple horizontal wells and those descendants, many of whom had never met this wise woman, were rewarded by her forethought and knowledge. Both through the receipt of bonus money and royalties from the production. I know because I assisted in locating these heirs and helping them execute leases.

Some have thought this advice ill-advised and after hearing their story there was agreement. The individual owned more than 1000 mineral acres under an area that was rich in minerals and his plan was to use the money for several different businesses. He invested wisely and made a great deal of money. This principal is juxtaposed to the normal idea where people have a small mineral interest and the money from the sale of the interest would may not be used to propagate investments. The key is to provide for those in our family who are to follow.

Another question is: why would someone reserve minerals under a tract or tracts of land where there has never been any oil or gas production and likely never will be? Answer: If you purchase an asset every component of that asset has value. If you give this value up and do not profit from it then you have left money on the table. Many people today will purchase a home in the city and when they sell they do not save and except from the sale (when and if they do sell later) all the mineral estate.

If you list the property for $200,000 and the buyer sends you a counter offer of $180,000 then take away the minerals. Use the tools you have available to get your price. Don't be shy. More couples than even are living together without getting married, whether never planning to get married or living together for a while prior to marriage. There are more than four million cohabiting couples in the UK now, with nearly half of children being born outside of marriage.

While a couple living together may not be a problem, it can become problematic if they separate. It can be confusing for people as they may not know exactly where they stand. For example, what happens if they own a home together or have children? Many have the wrong idea of family law in these cases, while others don't consider it when they first move in together. After all, to some, simply living in a house with another person may not seem that bigger deal even if they are a couple. Some assume that cohabiting couples have the same legal rights as a married couple, with the idea of common law marriage, where couples who have lived together long term automatically have the same rights as married couples. This is not the case; the idea of common law marriage in the UK is a myth.

The problem at the moment is that people don't really know where they stand, and many who think they know have the wrong idea. This issue has recently been in the news with the case of Ms Jones and Mr Kernott, who were an unmarried couple living together with their children. They separated and Mr Kernott moved out of the home with Ms Jones and the children continuing to live there, with Ms Jones paying the mortgage. Once the children had grown up Mr Kernott made a claim for the home, assuming he would be entitled to 50%. After many lengthy court battles the Supreme Court has awarded Ms Jones 90% and Mr Kernott just 10%. This could be a significant case in terms of determining entitlements of separating cohabiting couples.

Many legal experts have argued that with so many cohabiting couples the law needs to be changed and simplified. But how? There are many opinions as to what the law should be regarding separating unmarried couple who have lived together. Below are some of these arguments.

It should be balanced to reflect the assets that each person brought into the relationship.

This would be simple in many cases, as if one person owned the home the couple lived in, they would retain ownership after. Where both work, it would mean each keeping their own earnings. The problem would come where circumstances are different when they separate to when they moved in together. For example, if they have children and one parent gives up work to look after the children, then it would be unfair for this parent to be left with nothing. There is also the fact that just because one person owns the home doesn't mean that that person is paying the mortgage. At the same time splitting the mortgage payments could be conceived as being the same as splitting rent on a rented property. The thing with this argument is that it should simplify things where the circumstances are straightforward but it would not work where it is more complicated and things have changed over time.

In some ways this would be the easiest way for things to work, effectively bringing into law common law marriage. This would mean both halves of a couple would know exactly where they stand prior to moving in together and changes in circumstances would be taken into consideration during a separation. The reality, though, is that some couples when first living together have not got married for a reason; they do not want to be treated as a married couple. They might not be really for that sort of commitment, either emotionally or in terms of sharing assets in the same way a married couple does. Would it be right for a couple to live together only for a few months and then to have to split assets upon separation? And it could be argued that if you want to be treated as though you are married, then you should get married.

A couple should be able to make a legally binding agreement prior to living together

This could make things simpler. The couple could have a family law solicitor draw up a written agreement that states what would happen, and how assets would be divided if they were to separate. This would mean both know where they stand, and if they were to separate things would be fairly simple to sort out. However, changes in circumstances could prove problematic. For example they may have been splitting mortgage payments when they first lived together, but one person may have then been made unemployed and therefore hasn't contributed to the mortgage. It may not be considered fair, therefore, that this agreement would still stand.

Family law can be complicated, and can be even more so where cohabiting couples are concerned. There have been calls for a change in the law, and it seems as though this would be a sensible step considering the number of cohabiting couples these days. However, it is difficult to establish how exactly it should be changed, considering the differing circumstances of different couples and how they could change over time.

How Should the VA Rate a Veteran's Service-Connected Arthritis?

One of the more common medical conditions that military veterans seek to have service-connected is arthritis of the knees.

It should come as no surprise, then, that one of the most common errors that the VA makes is failing to properly rate arthritis of the knees.

Here is a general summary of how you can double-check the VA's rating to make sure that they properly evaluated and rated your service-connected arthritis of the knee.

Before getting started, it is important to understand that, generally, the VA is not permitted to "pyramid" ratings. A "pyramid rating" happens when the VA rates the same disability under multiple - and sometimes different - diagnoses. Read the regulation at 38 C.F.R. § 4.14 to learn more about pyramid ratings.

Arthritis is different. If a military veteran is service-connected with arthritis of the knees, that Veteran might be entitled to up to 3 ratings for the same condition. They key word is "might" - what is important is that the VA evaluate and rate the unique way that arthritis manifests in your knees.

Here are three (3) factors that the VA should look at to see how to rate arthritis of the knees for any military veterans.

1) Functional Loss. Functional Loss is a limitation to the range of motion of the knee. The VA Rater should focus on what the military veteran's medical records say about his/her ability to perform the normal working movements of the knee with "excursion, speed, strength, coordination and endurance". This aspect of arthritis of the knee is typically rated under the Diagnostic Codes 5000-5010 - (Diagnostic Codes and their criteria are found at 38 C.F.R. Part 4.)

2) Instability. Instability is the inability of the knee to play the "support" role it plays - an inability to keep you standing and balanced. If this limitation is present in your knee arthritis, the VA examiner should rate it using three (3) criteria under Diagnostic Code 5257:

a) slight (which equates to an additional 10% rating)

b) moderate (which equates to an additional 20% rating)

c) severe (which equates to an additional 30% rating)

3. Pain. The most common and recognizable manifestation of arthritis is pain. The VA typically does not consider pain in determining the proper rating for a disease or condition. Arthritis is a little different; even if there is no Functional Loss, the VA Examiner can grant a rating for pain if there is evidence that the military veteran is impacted by pain when he or she uses the knee in normal, daily, repetitive use and/or when pain limits the Range of Motion.

Confused? Don't worry. The VA Examiner probably is, too.

I have seen a lot of improper and bizarre ratings and evaluations of pain for service-connected arthritis of the knee.

In fact, I recently looked at a claim where the VA examiner rated arthritis as sciatica. Sciatica is a condition that relates to the nerves of the spinal cord; while pain may refer down the legs to the knees in sciatica, there was no diagnosis for the condition in the C-File - the examiner simply never figured out that arthritis and sciatica are two totally different conditions.

One caveat - the explanation above is simplified, and under the facts of your case, it may not be the right analysis. Ever case is different, every military veteran's medical situation is unique.

If you are a military veteran with service-connected arthritis of the knee, it is highly recommended that you bring your arthritis rating decision - and the code sheet - to an attorney or VSO representative that is familiar with the proper way to rate arthritis.

If you don't know what the VA Code Sheet is, it is even more important that you get it in to have someone review your rating to make sure you are getting all the compensation you are entitled to.

Why Families Should Not Put Household Employees on Their Business Payroll

As household employment specialists, we regularly have families come to us after attempting to put their nanny -- or other household employee -- on their company's payroll. While it may seem like an easy and logical way to handle a domestic worker's payroll, it typically results in expensive, time-consuming problems.

Business owners who have household workers need to keep their household and business payrolls separate.

The reason? Businesses are allowed to take tax deductions on their payroll expense. But the IRS requires that everyone on the payroll be a "direct contributor to the success of the business" and they've ruled that nannies and other domestic workers do not pass the direct contributor test. As a result, putting a household employee on the company books can result in the company taking an illegal tax deduction.

There are also employment tax filing issues. Generally, business enterprises are not allowed to include household employment activity on their business tax returns. The only business categories that are allowed to marry their household and business employment tax filings are Sole Proprietorships and For-Profit Farms. (Note: Even though they're given some latitude on the filing process, Sole Proprietorships and For-Profit Farms are still subject to the illegal tax deduction danger stated above).

Finally, there are issues with group benefit plans. We recently saw a case where a family put their nanny on the company health insurance plan. The nanny was later diagnosed with cancer and had medical bills in excess of $100,000. When the health insurance provider learned that she was a personal employee of the family, they denied the claim because she was not a direct contributor to the success of the company and, therefore, was not covered by the group policy. The company was forced to cover those medical expenses.

Instead of mixing business and personal payroll and tax filing processes, families with household employees should follow the household employment tax process, which has different foms, different processes and different deadlines (not to mention different labor laws in many cases). Reference IRS Publication 926. When handled properly, the family can take tax breaks on dependent care expenses through their personal income tax process.

The Bottom Line: Failing to keep the household and business payroll separate can result in the need to amend both corporate and personal tax returns and pay penalty and interest assessments. Additionally, it can expose the company assets if there's ever legal action from a disgruntled former household employee.

Why You Should Consider Collective Enfranchisement

Leasehold enfranchisement is also known as 'the right to enfranchise' or 'collective enfranchisement'.

It is a right granted to leaseholders by the Leasehold Reform, Housing and Urban Development Act 1993. It essentially gives leaseholders the right to force their landlord to sell them the freehold of their block of flats and requires a group of qualifying tenants to come together and agree that it is the right course of action to take.

This right is only open to residential properties under the 1993 Leasehold Reform Act and, assuming that tenants are successful in forcing their landlord to sell them the freehold, they then assume the responsibilities of the landlord. They are also able to extend their leases by a period of up to 999 years at a peppercorn rent, which basically means their lease becomes rent free.

The process of leasehold enfranchisement can often be quite complicated, but the 1993 Act lays down criteria that tenants need to meet in order to be eligible to buy the freehold from the landlord. It also sets out the process that needs to be followed if the tenants are going to be successful in their aims. It is wise to have a specialist leasehold enfranchisement solicitor on board as they will be able to explain everything to you and take you through the details of what you need to do.

The tenants involved in leasehold enfranchisement will commonly set up a company that manages the acquisition of the freehold and then takes on the responsibility of the landlord following the acquisition.

Why should I consider collective enfranchisement?

There are several good reasons why tenants often consider collective or leasehold enfranchisement. One is that as the length of your lease decreases, the value of your asset deteriorates. This means that the option to extend their lease by up to 999 years is appealing to a lot of tenants as it gives them more control over where they are living.

Another common reason for tenants to come together and force the landlord to sell the freehold is because they want to benefit from better maintenance services. Often, it is possible to get better deals and services on maintenance when the tenants take over the management of the building, particularly if they suspect their landlord of being wasteful. Leasehold enfranchisement is a good way of putting an end to service disputes.

As well as getting a better financial deal on maintenance, insurance and other services relating to the building, leasehold enfranchisement also gives tenants more of a say over how the building is run. This is appealing to a lot of leaseholders, especially if they have previously suffered under a poor landlord or felt that their views weren't heard.

It is often a lot easier to find mortgages on properties where the tenants have gone through the process of leasehold enfranchisement as they generally prefer to lend to people who own the freehold of their property because it provides more security. Also, tenants sometimes find that the value of their property increases quite a bit following enfranchisement as many people prefer to buy properties where the freehold is for sale as opposed to just the leasehold.

Why Credit Card Debt Buyers Can Never Win - Should Never, That Is

Any idea why debt buyers should never win a credit card lawsuit?

Answer: The Hearsay Evidence Rule.

The Hearsay Evidence Rule prohibits the admission into evidence of statements - oral or written - made by an out-of-court witness and offered to prove the truth of the matter asserted. [Hint: Start thinking about monthly credit card statements.

A digression first: For those who are new to credit card lawsuits, debt buyers are companies, often quite large, which are in the business of purchasing defaulted credit card debt and collecting for their own account. They don't pay a lot for the debt, and they can be pretty aggressive collectors. Debt buyers make BIG money, but they don't have to make it from YOU. Why? Because of the Hearsay Evidence Rule. To see how this works in your favor, let me ask a simple question: How does a debt buyer know how much to sue you for?

Answer: Somebody else tells them. [Somebody who won't be in court to testify]

Specifically, that somebody is whichever bank sold them the debt. The bank tells the debt buyer how much debt their pennies have bought, and that is ALL a debt buyer knows. They may also get the last monthly credit card statement which also reflects this amount.

Flash forward to the trial. To prevail, the debt buyer must prove damages. Damages is an essential element of every claim. The debt buyer's damages is the amount of the debt they allegedly purchased and have been unable to collect - even though they only paid pennies on the dollar. To prove damages, they will offer into evidence that last monthly credit card statement showing the amount you owe.

And when they do, you do exactly what?

OBJECTION, your honor. Hearsay.

You do this because you now understand that a credit card billing statement is nothing other than a [written]statement made by an out of court witness, offered to prove the truth of the matter asserted - that you owe X dollars. As such, the monthly statements are pure hearsay, inadmissible as evidence to prove the amount owe....or more precisely, to prove Plaintiff's damages. NO damages, no case. You win. Unless, that is....

...they produce a witness from the selling bank who testifies that the monthly statements are, in fact, authentic documents stating the correct amount owed. Which leads us to one final question...:

What are the chances that an original creditor will send an employee - say, from Delaware [Chase] or Virginia [Capital One] - all the way across the country to hang around court all day to testify in a case in which the bank has NO interest WHATSOEVER?

Not happening. I haven't seen it, and don't expect to. So the statements are out. And the amount of Plaintiff's damages is unproven. Like we said, No damages, no case. Judgment for the defense.

Actually, it's not quite that easy. So, you might want to line up some legal help. Why? Because judges will allow hearsay statements into evidence unless proper and timely objections are made. And SOME judges will allow it anyway.
