Your Legal Rights: Are You Scared Silly About Accessing Legal Rights Advice?

There are many reasons people may be scared silly about getting legal rights advice from an attorney. Here are just a few:

· You have to check your bank balance before you obtain any legal advice from an actual attorney...or...you fear the entire process is cost-prohibitive so you're fear results in taking inappropriate or NO action.

· You don't know the right questions to ask an attorney...Or...you're concerned that you won't understand the legal jargon you receive.

· You are scared silly that the attorney will learn that you are doing something illegal and...maybe you'll get turned into the court system.

· You just don't want to deal with the situation, hoping it will 'go away'.

So, why are YOU scared about getting legal advice?

With the economic concerns and instability of jobs these days, I can see how you might not want to find out your legal rights before you know if you can afford them. Attorneys generally charge hundreds of dollars an hour for their services. Then, there's usually a retainer fee for the attorney to get started on your case. Wouldn't it be beneficial to you to NOT have to check your bank balance whenever you needed legal rights advice or legal help?

Listen, you know how to explain your situation to a friend, but you question your ability to have the right words to address an attorney. Reminder: attorneys are people, too, and if you can explain your legal concerns to someone else, you can explain it to an attorney. Attorneys have talk to many people of many different backgrounds every day and certainly they can understand you. They also can speak clearly and take the time to explain terms regarding your legal questions or concerns.

As far as asking the correct questions, as long as you tell attorneys about your situation fully, you can ask them which questions you should ask (in court, mediation session, or whatever the case may be). You can ask them to explain things in another way if you don't understand the way they presented it. Attorneys really are trying to help, and are not as scary as you may think they are.

If there's something illegal in your past, you could either talk to an attorney about whether it would be good to discuss it with them or not before telling them details, or you could leave it out of the conversation. If it has nothing to do with the task at hand, it may be better to talk about it another time anyway. Just focus on why you need to talk to the attorney now.

Many people have negative situations in life with which they just don't want to handle. It's understandable if talking to an attorney gives you hives or makes you nervous just thinking about it. However, the situation is probably not going to go away just because you don't want to deal with it. Chances are, the longer you put off the situation, the harder the situation will be to deal with. That's generally how it works with procrastination; yet, if you take care of it promptly, you'll feel much better and it won't be consuming your life like it may be.

There are many reasons people don't look for legal help. However, there are many solutions that can truly help and make it easy to talk to an attorney any time. A solution could be to ask an attorney about your situation and find out how easy it can be. There are many options for attorneys or legal services that can help in any situation or location.

Legal Interpreting: 8 Facts to Know About Court Interpreters

In order to preserve a sense of fairness in a multilingual society, the U.S. court system has incorporated an official code of conduct for those working in the legal interpreting profession to follow. Legal interpreters are extremely important as they aid those with limited English proficiency (and/or the hearing impaired) in order to access justice. Though there may be discrepancies from state to state, there are core principles that every court interpreter should abide by.

In order to fully understand legal interpreting and what it will be like to work with a court interpreter, there are a few things you should keep in mind:

1. Were rarely employed in the past. It used to be the case that legal interpreters were only appointed in very rare cases, which left those who were not able to effectively communicate in English to struggle. Thanks to the Fourteenth Amendment, interpreting services for limited English-proficient and non-English speakers are essential in order for justice to be served.

2. Stress importance on accuracy over clarity. A legal interpreter must remember to always accurately interpret what is said in court and preserve the tone, inflection and emotions of the individual speakers, all the while speaking clearly. This means even if slang, obscene or colloquial language is used, the court interpreter must express those words. It is not a part of legal interpreting to simplify statements in cases where two parties don't speak at the same language level.

3. Avoid unnecessary conversations. A neutral attitude must be maintained by legal interpreters at all times in the courtroom. Therefore, it's best to avoid unnecessary conversations with them in that space.

4. Constantly learning. A court interpreter not only strives to improve their knowledge of language, but also that of law. They aim for fluency in legal diction, but are allowed bilingual and legal dictionaries to reference back to while in court.

5. Trained to blend in. Legal interpreters should be on time, dressed in business attire, have a sense of familiarity with the courtroom, and speak clearly. Other than that, they are to remain in the background and be as out of the way as they can possibly be.

6. Prepares for each case. It is usually required that legal interpreters review all materials provided by legal counsel in order to be prepared for an assigned case.

Some of these documents may include:

-Charges
-Police reports
-Official complaints
-Interview transcripts
-Indictments

7. Uses first person. Legal interpreters should firstly be comfortable with the mode of interpreting chosen by the court. Once they have identified themselves to the court, legal interpreters are usually expected to speak in first person when they are interpreting for non-English speaks who are giving their testimony.

8. There is little margin for error. If they sense the quality of their work may decline due to something such as fatigue, interpreters are expected to inform the court. If they suspect they have made an error while in court, they must correct it immediately. If they suspect they have made an error after the testimony, they must ask for a conference with the judge to explain and correct the error in the record. If a court interpreter shows a lack of proficiency or preparation, or is unable to perform their job due to trouble understanding the speakers or finding the correct legal terms, they will be asked to withdraw from the case.

How to Identify DUI Cases, and What to Do About Them?

Road accidents caused by drunk driving are increasing day by day. So much so that 50% of all holiday fatalities caused in driving accidents are alcohol-related. Since it is becoming a major concern, it is every citizen's job to stand up and do something about it. The first step is for each to be cautious and responsible on their part.

The second responsibility as a good citizen is to report any drunk driver that one might come across. Fortunately, they aren't very difficult to spot as most suspicious driving behavior is caused by a drunken person in the driving seat. So, the car tends to imitate the inebriation of the person driving it, making him/her easy to spot. There are many kinds of behavior one needs to look out for. For example, look out for such drivers who are tailgating, which is driving too closely to another vehicle. If you can, get a close look at the driver. If he/she is drunk, there will be some obvious signs such as his/her face being too close to the windshield or being fixated at something. Some of the drunken drivers even openly drink while driving, making it even easier to spot such cases.

Some of the other signs of drunkenness include taking turns with a greater radius, turning abruptly or suddenly, braking erratically, stopping inappropriately, like, at a green light or just stopping without a cause in a traffic lane.

Some drunk drivers drive in a zigzagging pattern on the road, while others drive in the direction opposing the traffic flow, and show delayed responses to traffic signals. Some drunken drivers tend to over-speed, which can be fatal to both the driver and the surrounding pedestrians alike. On the other end of the spectrum, some drunk drivers drive so slowly that they cause a hold-up. All of these are indications of an intoxicated driver and they should not be ignored.

Now the question is, what to do once a drunken driver is identified? Naturally most of us would have the urge to follow him or stop him. Don't! That's not your job and you are neither trained nor qualified to do it. The only thing you should do is ensure your own safety first by staying as far away from that vehicle. Do not try to get too close because the driver may stop abruptly or unexpectedly, do not follow the vehicle, and by all means, do not try to stop the vehicle or act in the position of a law enforcement officer or a medical professional. What you should do, instead, is fasten your seat belt. Next, find a phone, and call the police. First you state that you're calling to report a drunken driver. Then you give the car's exact location, followed by the description of the car including, the model of the car, the color and the license number. Finally you briefly explain the driving behavior, and then you let the police do their job.

Most People Won't Learn About Insurance Fraud Investigators Until It's Too Late

According to the Coalition Against Insurance Fraud, insurance fraud costs Americans 80 billion dollars a year. The perpetrators of this kind of fraud aren't usually hardened criminals with reset noses and a constant sneer - usually, these crimes are committed by smart people who think of fraud as a way to make a bunch of money without working for it. But awareness can stop them dead in their tracks. Read along and learn some of the main types of insurance fraud, what you can do to prevent it, and where to go for help.

Workers Compensation Fraud

Legitimate workers compensation is a godsend to so many hard-working people who have a run of bad luck. But workers comp fraud comes in a variety of forms, and it's tough for a business owner to have his eyes open for all of them. But when a worker:

Refuses to disclose a nagging injury he had before signing on,Claims he got an injury on the clock when he got it after hours,Fakes or exaggerates an injury,Collects benefits from more than one employer for a legitimate injury, orWorks one place while getting workers comp from another employer

They aren't just skimming a little bit off the top. They're committing a crime. As a preventative measure, companies might refer injured workers to clinics they trust to report honest information. But once they suspect there's fraud in place, a private investigator can conduct interviews, do surveillance, and run background checks on their medical history and claim history.

Automotive Fraud

Investigation for this kind of fraud isn't easy to track, and it's distressingly common. When a staged rear-ender happens, or a legitimate accident is exaggerated, a claimant can collect a sizable amount on their auto insurance policy. The cons don't stop with phony car thefts and falsified applications - there are even recorded incidents of scammers getting insurance on cars that never existed in the first place!

But there are also countless unique, external factors that can create a legitimate accident. Whether it's the weather, the condition of the roads, or the speed of the vehicles involved, they can all make an impact on the damage the cars involved. Those differences can be subtle, but make no mistake - they do exist. A single missing detail can unravel a tangle of lies and help everyone involved determine who, if anyone, is liable for an accident.

Medicare Fraud

There are two major kinds of Medicare fraud. The first is called member fraud, and happens when a policy holder withholds vital information from their provider. The second is much more common - it's called provider fraud. You can protect yourself by staying away from:

Telemarketers and door to door salesmen.Companies that waive co-payments and don't check your ability to pay.Salesmen that aggressively sell you on stuff you don't need.Strange information and rumors about "secret" changes to the Medicare program.Anybody that asks for access to your Medicare card. For any reason.

If you run into any of these, it's a good sign something's up. If you suspect something's gone wrong, get a PI. They'll usually look into your Medicare Summary Notice and check it for irregularities.

We're insurance fraud investigators that work with honesty, integrity, and an open mind - and we try to benefit our client whether he's a wealthy employer or a regular guy that's down on his luck. Important Things to Know About Filing Bankruptcy

In today's economy, a growing number of people are finding it hard to make ends meet. With so many out of work and not able to pay their debt obligations, often it seems that the only answer is calling up a bankruptcy attorney and getting the process started. While bankruptcy can be a good solution for some people/families, it is not always the best option.

In order to help better understand the process and if it makes sense in your particular case, here are some common questions people often ask about bankruptcy:

What is Chapter 7 Bankruptcy?

Chapter 7 is a type of personal bankruptcy whereby the debtor is permitted by the court to discharge certain debts, meaning the debtor is absolved of any liability to repay those debts. Debts normally included in a chapter 7 bankruptcy are unsecured loans such as credit cards and medical bills. Examples of common unsecured debts that CANNOT be discharged through a Chapter 7 include government-backed student loans, child support/alimony, and back taxes.

How Does a Chapter 7 Filing Work?

When a debt is discharged under a chapter 7 bankruptcy, the court orders the creditor to halt all collection activity on the debt owed. This means that the creditor must stop all phone calls, mailings, or any other form of personal contact with the debtor.

When Does Filing Chapter 7 Bankruptcy Make Sense?

When a person or family has a significant number of unsecured loans like credit cards and/or medical expenses and lacks the income to keep up even the minimum payments on them, then Chapter 7 bankruptcy may be the best option.

A typical scenario where a Chapter 7 might make sense is if the primary earner in the household becomes unemployed and/or disabled with very little prospect of finding decent paying work for the foreseeable future, and the family has a high amount of unsecured debt with little hope of paying it back. However, since each individual case is unique, it is always recommended to schedule a consultation with a bankruptcy lawyer to find out what's best in your case.

What is a Chapter 13 Bankruptcy?

A Chapter 13 is the other type of personal bankruptcy. In contrast to a Chapter 7, Chapter 13 does not completely discharge your unsecured debts. Instead, it works more like a debt consolidation in that it allows you to submit a plan to the court on how you will pay off your debts over a set period of months/years. If the court approves the plan, they will order the creditors to halt personal contact with the debtor. The debtor will then make a set monthly payment, which will be then divided up among the creditors in a fashion that is agreed upon by all parties.

When Does it Make Sense to File a Chapter 13 Bankruptcy?

A Chapter 13 bankruptcy may be a good solution if you are behind and unable to make all the monthly payments on your various debts, but still have a steady monthly income. The effect of a Chapter 13 is to lower your interest and/or monthly payment obligation to a level that is deemed affordable, so you can eventually pay back your debts, just over a longer period of time than is called for under the current payment schedule.

If I file bankruptcy, will I be able to keep my house?

In most cases the answer is yes. As long as the equity in the home is exempted (which is usually just a matter of the bankruptcy lawyer petitioning the court for the exemption and the court approving it) you should be allowed to keep your home. In cases of a Chapter 13 filing, there should be no problem keeping your home as there are no actual debts being discharged during Chapter 13, and you will usually be making the same monthly mortgage payments as you were previous to the filing.

How does bankruptcy affect my credit?

Bankruptcy will stay on your credit report for 10 years. However, if you are in a position where it makes sense for you to file bankruptcy, your credit is likely already severely damaged. By filing bankruptcy, you are able to discharge most, if not all of your unpaid bills, meaning these debts will eventually disappear from your report altogether, leaving just the bankruptcy and any new credit obtained thereafter. If you are able to avoid getting behind on bills after the old unpaid debts are discharged through bankruptcy, it is possible that your credit will become stronger after the proceeding is over.

Can I file bankruptcy without affecting my spouse's credit?

It depends. If you have debts with both spouses' names on it and want them discharged through bankruptcy, then either both spouses need to file, or the spouse not filing bankruptcy will usually be held liable for the debt. If all the debts being discharged are in the name of the spouse filing the bankruptcy, then it should not affect the other spouse's credit.

There is one thing to keep in mind when it comes to joint debts and bankruptcy; if one spouse files and both spouses later apply for joint credit, the credit approval decision will normally be based upon the spouse with the lower credit score.

What is the cost of a typical bankruptcy attorney?

This depends on the type of filing and the region of the country you are in. A Chapter 13 is more involved because the bankruptcy attorney will be representing you for up to 5 years. On the other hand, a Chapter 7 should be over and done within a year at the most. For this reason, a Chapter 13 will almost always cost more than a Chapter 7.

For a Chapter 7 bankruptcy, lawyers charge generally between $750 and $2500, depending upon region and complexity of the case. For a Chapter 13, the bankruptcy lawyer may charge somewhere between $2000 and $4000, again depending on region and complexity. In most cases, the bankruptcy lawyer will not charge the entire fee all at once, and will allow you to set up a monthly payment plan.

Myths About Child Abuse

Turn on the TV and it is not hard to hear about the child molestation accusations that were made against Jerry Sandusky in the last two months. If you are like me it is difficult to wrap your mind around the possibility of a coach molesting children, especially someone in a mentoring role. Here are a few myths that I think that are worth squashing about child abuse.

Only bad people abuse their children.
Fact: Not all abusers intentionally harm their children. Many have been victims of abuse themselves and don't know any other way to communicate.

Child Abuse doesn't happen in "good" families.
Fact: This crosses all racial, economic, and cultural lines. Sometimes families who seem to have it all from the outside can have a completely different story behind closed doors.

Most child abusers are strangers.
Fact: A lot of times the abuser is a family member or a person who has some sort of a relationship with the family, such as a teacher, coach, or a neighbor.

If someone you know has been abused there is help; this is not something that should stay hidden like it did years ago. Below are some items to consider when bringing a lawsuit against someone that has abused a child.

Bringing a Lawsuit for Child Abuse
Time is of the essence. There is "statue of limitations" which is the time limit for when you are permitted to bring a lawsuit. Our office will be able to help you to learn more about the time limits for bringing a child abuse lawsuit in your area.

Civil vs. Criminal Court

Civil Suit- involves the victim suing the person who committed the child abuse against them in order to recover monetary damages for their injuries. If you want to sue someone for your child abuse injuries, or are being sued by the victim for money, you would be in civil court and would need an experienced personal injury lawyer.

Criminal Suit -involves a person who is being prosecuted by the district attorney's office for committing child abuse against a victim.

Victim of Abuse
If you or a loved one has been a victim of child abuse, you should speak to a lawyer immediately to learn more about preserving your rights and seeking remedies. A lawyer will be able to explain the value of your case and help you navigate through the complicated legal process.

All medical personnel, clergy, law enforcement, state agency employees and teachers are legally mandated to report their suspicions, but child abuse often goes unreported and can injure a whole community. Remember, when a child is abused, it is everybody's business.

Felony Attorney - 5 Lies About the Criminal Justice System

Myths about the justice system that are propagated by television crime dramas and films make it difficult for a felony attorney to separate the lies from reality to their clients. Many people hire a lawyer with preconceived notions on how the process should run, which usually just ends up causing more harm than good. Here are some common misconceptions debunked.

1. Police Interrogation

In many crime dramas a suspected felon is escorted into a private room, often with a two-way mirror installed, and is given a brutal interrogation by an officer. This may go on for hours and either results in a startling revelation, a confession, or a stalemate. Real interrogations are nothing like this. You may be asked a few basic questions, and they may even try a few scare tactics to elicit a desired response, but more often than not they end quickly as soon as the words, "I want to see my lawyer," are uttered.

2. Forensics Made Easy

One single particle of fluff is often used in movies and television to convict a criminal and send him to prison for life. In the real world, DNA is not the end all be all of crime investigation. While it can be useful, without substantial supporting evidence and testimony a positive match isn't necessarily going to wrap up a case. It's especially difficult to use DNA effectively if the suspect has had any known relation to the victim. Even visiting a home once can result in leaving behind some "evidence." Forensics are always much more complex than how they are depicted for entertainment.

3. Witnesses Win Cases

A court case isn't a game of who can call up more witnesses to a stand. While a witness testimony can be powerful evidence against an alleged suspect, a felony attorney who is not able to gather supportive witnesses in favor of their client is not a failure. Disproving a witness can be even more effective than having someone else corroborate in favor of the defense. Cross examination is crucial during a trial, so don't assume you've lost just because the prosecution has dug up more witnesses.

4. No DNA, No Case

While positive forensics tests that link to a suspect are not as definitive as some might think, likewise a lack of any substantial DNA evidence is not proof of innocence. A felony attorney must construct a defense that is strengthened by multiple facets of evidence in addition to a lack of any forensic finds.

5. Wacky Arguments

Court dramas are full of larger-than-life lawyers who use humor, creative examples, and general wackiness to capture the jury's attention as well as successfully defend their client. The reason this is done is because most trials are very boring and follow a specific protocol. There isn't room in the courts for dramatic speeches, fist pounding, and the high levels of exuberance that is usually displayed on television. During a real trial, the measure of a lawyer's success isn't how outrageous they are, but rather how well they communicate in a professional manner.

The felony attorney Baton Rouge defendants need is highly skilled at getting their clients back on the road to success. Don't let a shady trial get the best of your bright future. Use your one phone call to make a great decision and call for representation from http://josephkscott.com/

What Do Do About the Missed OVDI

And the Internal Revenue Service demands to know where all the taxpayers foreign accounts are located --- it is a crime to keep these foreign bank account secret if they are over $10,000.00 in value. The Internal Revenue Service offered two previous offshore voluntary disclosure initiatives. One in 2009 and the last one in 2011. The last one passed on August 31, 2011. For those people wondering what to do, this piece discusses their four remaining options.

Option One: Do nothing. You could do nothing and hope that the Internal Revenue Service does not discover the foreign bank account. Perhaps your account is at a foreign bank that you believe to be "off the radar" or is in a quiet country, or under a friend's name, or opened with a non-American passport. Well, it used to be that a bank account's true owner could be kept anonymous. However, now, the Internal Revenue Service has vastly many more tools than it ever did previously to find hidden accounts.

Here's the thing - every global banking and financial organization must be in the American market otherwise it would become such a small time player that the foreign bank's shareholders would revolt. Despite everything you may have heard, the American is still by far the largest economy in the world and every global bank must be on the good side of the Internal Revenue Service - otherwise that foreign bank will be shut out of getting American capital or customers! Part of being on the good side of the Internal revenue service is to disclose what the Internal Revenue Service says to disclose. Therefore the bank is really at the mercy of the Internal Revenue Service....meaning so are the banks' account holders. So you see, hiding becomes riskier and riskier. And once the Internal Revenue Service starts an investigation, there is only one option left...pay outrageous taxes and the highest penalties and face the significant possibility of real jail time.

The second option is to renounce citizenship and leave the country - as there is no other way to escape the power of the Internal Revenue Service. But be warned - expatriation only works to avoid future tax debts and conformity troubles. The only way to correctly forsake is to fundamentally come forward about all offshore bank accounts and actually forfeit an expatriation excise (in many ways it was easier to leave Soviet Block country than to leave the USA completely intact with your wealth.)

The third option is to quietly filed amended 1040X's and not explicitly tell the IRS that you are seeking to voluntarily disclose. This is known as a "quiet" or "soft" disclosure. The advantage is that there is little upfront cost to this. But the disadvantages are that you may give the IRS a very handy clue to charge you criminally, and if you are caught, you are see high penalties and a possibility of criminal charges.

There may be serious problems with this alternative. One major drawback is that the Department of Justice states that it has begun criminal proceeding against taxpayers who attempted to utilize the "soft" disclosure process.

The "soft" disclosure option is incredibly risky for several reasons. One reason is that a soft disclosure does not remedy the problem of the taxpayer's non-compliance in FBAR filing; as a willful failure to file an FBAR is a criminal charge. So simply filing a quiet disclosure 't go far enough to remove any likelihood of criminal charges. In fact, the 1040X might - well here's the terrific dilemma with this option - it does nothing about the failure to the FBAR. There are still criminal and civil investigations that may be pending for failing to file an FBAR, but simply give the Internal revenue service a very handy to find you.

The forth option is a pre-emptive disclosure and subsequent negotiation of the penalties. This is the best option. Even though the time to disclosure under the 2011 initiative has expired, there is time to act. The only deal that passed on August 31, 2011 was the specific off-the-shelf terms of the 2011 OVDI. The 2011 OVDI was simply a pre-agreed upon penalty structure. The Internal revenue service always welcomes voluntary disclosures.

There are two main requirements. First, the taxpayer can't already be under audit or criminal investigation. And next, the foreign assets can't be connected to criminal activity - like currency laundering or drug trafficking. Once these qualifications are satisfied, criminal crimes come off the table and the case is referred to the civil division for assessment of taxes. A successful OVDI offers reduced penalties and a guarantee of absolutely no criminal charges. Although fines and penalties may be substantial, they are insignificant compared to an.

Such pre-emptive off-shore disclosures and negotiations must be handled by a qualified OVDI attorneys, skilled in offshore compliance and sensitive IRS negotiations.

Recent trends in tax evasion may be solved through OVDI.

Knowing All About Supplemental Security Income or SSI

One of the best known programs of the Social Security Administration (SSA) is the SSDI, or Social Security Disability Insurance. This program provides monthly assistance to persons with disability who are unable to work. Aside from monthly assistance, SSDI beneficiaries are also entitled for other benefits under the Social Security program. One of these programs is the Supplemental Security Income or the SSI.

The task of the SSI program is to provide persons with disability, the blind, and people aged 65 and above with financial needs. People under this program will be given payments that will meet their basic needs. Like the SSDI program, the payments are given in a monthly basis. But unlike the SSDI program that uses Social Security funds from FICA tax contributions of regular employees, the SSI program instead uses general tax revenues.

The SSA has its own rules in determining eligibility for SSI benefits. One of the main rules for SSI eligibility that must be followed is on the aspect of citizenship. A person can be qualified for SSI benefits based on his residency in the Unites States. He must be either a US citizen (born in the country or born outside of the country and has dual citizenship), or a non-citizen with provided documents regarding alien residency.

Another rule for SSI eligibility is on the aspect of ownership and earning capacity. A person or a couple applying for SSI benefits must have "limited" income. Income that is earned through employment, from workers compensation, and from immediate family members constitutes a "limited" income. The SSA, though, does not approve all other types of income. The total monthly income computed would determine the amount of benefits a person or couple will get.

A person or couple must also have "limited" resources in order for them to receive SSI benefits. Resources are the things owned by the person or the couple. Resources, such as cash, checking and saving accounts, cars and other vehicles, property, and other cash-convertibles are included. The SSA has already set a limit for the total cost of resources owned by either applicant. A person must not have more than 2,000 dollar, while the couple must not exceed 3,000 dollars.

Issues regarding Supplemental Security Income generally include overpayments. Sometimes, for some reason, a beneficiary receives more what is due in a monthly basis. Having a California disability attorney will help if there is an overpayment or any untoward matter regarding a person's SSI benefits.

Ashley is an online writer. She spends so much time in internet surfing and reading about legal/law matters. She is an advocate of rights and dedicated on writing California disability attorney and Retirement Survivors Disability Insurance articles to date.

About to Take Your Case to Court?

Eleven Ways to Improve Your Trial Skills

In other pieces we've discussed how to prepare for trial by organizing all your information and by creating a trial notebook. But as you well know, there's a world of difference between being organized and truly being ready. Once you step into court, organization helps, but winning depends entirely on how well you've honed your T.R.I.A.L. S.K.I.L.L.S.:

Toastmasters - Improve your public speaking abilities and confidence. The more you speak in public, especially in front of seasoned speakers who can constructively critique your style, the better you'll be in a trial setting whether questioning a witness on cross examination or delivering your opening or closing remarks.

Rest, Diet, and Exercise - Feeling and looking your best can sway a jury. More importantly, your energy levels will dictate how well you can focus on your case and keep up with the pace of trial.

Image - Visit an image consultant since people really do judge a book by its cover. How do you come across to others? As a together winner or as someone who's totally out of their league? Sad to say, but you'll be sized up by opposing counsel, the judge, and the jury based heavily on your appearance.

Analytical Thinking - Work puzzles or play chess to exercise different parts of your brain. You may know all applicable legal statutes and precedence by heart, but unless you can organize your thoughts to know which facts to whip out at the right moment, or how to convince a jury by logic alone, your court room results may be less than stellar.

Law Courses - Constantly brush up on the core of your profession. Logic and organization are only as good as the subject on which they're focused. Always stay abreast of legal issues, case law, statutory law, cases adjudicated or pending in higher courts, and current and pending legislation.

Software Tutorials - Technical skills are as useful in court as any reasoning skill. Keep up with the software and hardware you'll be using and know how to handle those inevitable curve-balls your computers and software packages will throw at you at the worst possible moment.

Know how to Debate - Trial is an organized argument; a debate. The better you are at understanding the opposition's position and approach, the more successful you'll be. Provided, of course, that you can organize your side of the debate into either a presentation of facts or a persuasive oratory. Many metro areas will have a debate club. Though some might consider this a "nerdy" activity, keep in mind how much your enhanced skill set can add to your bottom line.

Investigation Courses - The more you know about the investigative process the better your understanding of the case itself. Though you should generally outsource full investigations to licensed and experienced investigators, you're the one that will be in charge in court. The better your "detective instincts" the better you can spot the flaw in the opposition's case, read jurors' body language, or detect deception in a witness.

Legal Assistance - In his book "The Tipping Point," Malcom Gladwell pointed out that in general, people who spend 10,000 hours or more practicing a specific activity become expert in that activity. One thought here is to spend time volunteering to help the indigent. The more time spent in court the better you become, so pro bono work really does have its benefits.

Libraries - Spend more time reading in general. This works different areas of your brain and keeps your thinking sharp. In fact, reading good mystery novels helps keep the analytical portions of your thinking young and energetic. Reading is great, but the other side of that coin is writing. Take a creative writing class if you can find the time. Not only does it help keep your reasoning razor sharp, but it will help with your written presentations to the court, handouts for the jury, labeled visuals used in trial, and any number of areas where your written word might as well be etched in stone.

Sales Training - A presentation in a court of law is a sales presentation pure and simple. You want to sell judge and jury on your client's position with a combination of facts and persuasion. One great way to develop that particular skill set is through salesmanship training. Most metro areas will offer courses. Check leisure or continuing education guides for your location.

Worried About A Relative's Guardian? How Litigation Attorneys Can Help

When most people hear the word guardian, they immediately think of children whose parents have died. However that's not the only time you might be faced with a guardianship situation. Whether you know a child whose parent has become unable to care for him or her, or your parent or grandparent is suddenly unable to care for him or herself properly, you might know someone who needs a guardian.

Why Would You Challenge Guardianship

Most of the time, the person acting as the guardian is looking out for their ward's best interests. Sometimes though, there can be problems. The guardian could be mismanaging an elderly person's money, physically abusing them, neglecting them or more. Challenging a guardianship doesn't always have to happen because of conscious abuse though. Sometimes the guardians suddenly find themselves unable to care for their ward, but they might not realize it right away. In these cases, it's a good idea to protect your loved one and challenge the guardian's rights before serious harm occurs.

How To Challenge Guardianship Without A Lawyer

It's possible to challenge a guardian without using litigation attorneys. You will need to go to your local courthouse and fill out paperwork asking the courts to name you as the one responsible for the elderly person or minor child. Doing this yourself can be a good idea if you don't think there will be a conflict when requesting this change or if the current guardian no longer wants the responsibility of caring for the minor or elderly relative. To avoid family conflict or drama, consider talking to your relatives before you file a petition. They may agree that you're the best choice for the responsibility and hand over duties without a fuss.

Why Use A Litigation Attorney

However, if you think there will be a battle in order to gain guardianship over your loved one or if you need to prove neglect, abuse or mismanaged money, it's a good idea to hire a litigation attorney. Litigation attorneys who specialize in these issues will know which forms to fill out and more importantly, how to prove that you are the best option to take care of your loved one. A litigation lawyer will know what type of evidence you'll need and how to present it to the court to best help your chances of winning. In some cases, the ward might be unable to testify on their own behalf, which is why evidence and witnesses can be so important to your case.

Guardianship is a tricky situation and not handling it the right way can cause family strife and costly legal battles. Instead, try to talk to your family about determining who can best handle guardianship of a minor or elderly family member before using a litigation lawyer to challenge it in court. If you do require legal assistance, find litigation attorneys who can help you win in court. Your loved one's well-being depends on it.
